Terms of Service

These terms cover your use of Bloom Growth Studio ("the service"), a tool for producing advertising creative and publishing it into your own Meta ad account. By using the service you agree to them.

Your account

Accounts are issued to named people. Keep your password to yourself and tell us if you think someone else has it.
You are responsible for what happens under your account.
We may suspend an account that is being used in a way that breaks these terms or puts an ad account at risk.

Acceptable use

You agree not to use the service to:

Publish advertising that breaks Meta's Advertising Standards or any applicable advertising law — including misleading claims, medical or health claims you cannot support, and content that targets people on protected characteristics.
Upload material you do not have the rights to, or impersonate a person or brand.
Connect an ad account, Page or Instagram account you are not authorised to manage.
Attempt to break, overload, scrape or reverse-engineer the service, or work around its spending limits and safety checks.
Resell access to the service without our written agreement.

You remain the advertiser of record. You are responsible for reviewing every ad before it runs, and for the claims it makes.

What the service generates

Creative is produced with AI models and may need editing. Review it before use. As between you and us, the creative you generate for your own campaigns is yours to use; we may keep a copy so the tool can learn from results and so your team can reuse it. Similar output may be produced for other users from similar inputs.

No guarantee of ad performance

Advertising results depend on your offer, your market, your budget and Meta's own delivery systems. We do not guarantee any level of impressions, clicks, sales, return on ad spend or any other result, and nothing in the tool — including its scores, predictions, experiment verdicts and recommendations — is a promise of performance. Those are estimates from past data, and they can be wrong. The service is provided "as is", without warranties beyond those the law requires.

Money you spend on ads

Ads created by the service are always created paused; spending starts only when a person activates them in Meta Ads Manager. Your advertising spend is paid by you directly to Meta, under your agreement with Meta, and is not part of the fees below.

Fees

Fees for the service are as agreed in your order form (a percentage of attributed ad spend). Unless your order form says otherwise, fees are invoiced monthly in arrears and are payable within the period stated there. Taxes are your responsibility. Fees do not include the ad spend you pay to Meta or the cost of any third-party service you connect.

Availability and changes

We improve the service continuously and may change or remove features. We aim for reliable availability but do not promise uninterrupted service, and maintenance or an upstream outage (Meta's API, a model provider) can interrupt it.

Suspension and ending the agreement

Either side may end the agreement as set out in your order form. You may stop using the service at any time and ask us to delete your data (see the Privacy Policy). We may suspend access immediately if continued use would endanger an ad account, breach Meta's policies, or break the law.

Limitation of liability

To the extent the law allows, neither side is liable for indirect or consequential loss, including lost profits, lost sales or wasted ad spend. Our total liability for any claim is limited to the fees you paid us for the service in the three months before the claim.

Privacy

Our handling of data is described in the Privacy Policy, which forms part of these terms.

Governing law

The bracketed items, the fee terms above and the liability cap should all be reviewed by counsel against the signed order form.
